Cutting Down a Tree

Cutting down a healthy tree is prohibited throughout the Town, except in certain situations provided for under municipal regulations. Before cutting down a tree on your property, you must determine whether a certificate of authorization is required and whether the reason for cutting down the tree is permitted.

Applicable regulations

The provisions governing tree cutting, pruning and protection are set out in Article 5.6 of Zoning By-Law No. 90-58.

A certificate of authorization is required to cut down any tree with a diameter greater than 10 cm (4 in), measured 15 cm (6 in) above ground level. No specific authorization is required to cut down a tree with a diameter below this measurement.

Cutting down a tree may be authorized for any of the following reasons:

  • the tree is dead or diseased
  • the tree is causing damage to the property
  • the tree poses a risk of falling branches or another potential hazard
  • the tree must be removed to allow for new construction or a building extension

The applicant must be able to justify the reason for cutting down the tree.

Before the inspection, tie a string around the trunk of the tree identified in the application so that municipal staff can clearly identify it.

How to Submit an Application

The application form for a tree cutting certificate of authorization may be:

  • obtained from the Public Works Department at 25 Claude-Jodoin Street
  • downloaded and printed by clicking here

All sections of the form must be duly completed to avoid delays in processing the application.

The completed and signed form may be submitted in one of the following ways:

  • In person: Municipal Garage, 25 Claude-Jodoin Street, Kirkland
  • By mail: 17200 Hymus Boulevard, Kirkland, Quebec H9J 3Y8

Processing Time

The application will be processed within 20 working days following receipt of the form. If the application is approved, the certificate of authorization will be sent to the applicant by email.

By completing the form, the applicant understands that the information provided will be accessible to municipal employees involved in processing the application. This information will be retained in accordance with the Town’s security standards and records retention requirements.

Any tree cut down in the front or side yard of a private property must be replaced within 90 days following its removal.

The replacement tree must:

  • be at least 1.5 m high
  • be one of the permitted species
  • be planted in an appropriate location on the property

Choosing a Location for the New Tree

When planting the new tree, avoid encroaching on the street right-of-way, where underground utilities and infrastructure are generally located. If repairs to this infrastructure become necessary, a tree located within the municipal right-of-way may need to be removed.

The water service valve located in front of your property is generally situated near the right-of-way line and may be used as an approximate reference point. If in doubt, contact the Town before planting a tree.

Helping the New Tree Survive and Thrive

During its first three years of growth, a newly planted tree requires special care, including adequate watering and proper protection of its trunk, roots and surrounding soil.

All trees within the Town must be protected, regardless of their size.

Any tree with a diameter greater than 10 cm (4 in) that could be damaged during construction work must be adequately protected, whether it is located on private or municipal property.

It is also prohibited to trim, prune or cut down any tree or shrub belonging to the Town. Such work may only be carried out by authorized municipal employees or, when necessary, by utility company tree-pruning crews.

It is also prohibited to cut or uproot flowers and plants belonging to the Town.

When a tree located on private property:

  • interferes with the lighting provided by a streetlight
  • obstructs the visibility of a traffic sign
  • poses a risk to public safety

the property owner or occupant must correct the situation.

The Town may issue a notice requiring the property owner or occupant to:

  • prune the tree
  • cut certain branches
  • remove the tree entirely

The required work must be completed within 10 days following receipt of the notice.
